
FMCSA shuts down Nevada-based trucker, and declares driver imminent hazard to public safety after 40 violations in 2 years

Today, the Federal Motor Carrier Safety Administration declared a Nevada-licensed commercial driver Mamadou Diaby to be an imminent hazard to public safety and has ordered him not to operate any commercial motor vehicle in interstate commerce in a press-release. Diaby was served the federal order Jan. 3, shutting down his registered trucking company, 4 U Logistics, Inc.
According to a statement from the FMCSA, on Dec. 12, Diaby was operating a 4 U Logistics tractor-trailer en route from Missouri to Colorado and was seen driving erratically. He was stopped by Kansas Highway Patrol Officers and failed a field sobriety test, recording a significantly elevated blood alcohol level. Officers later found opened alcoholic beverage containers in a cooler next to the driver’s seat.
Also during the Dec. 12 stop, officers discovered Diaby’s trucking company, 4 U Logistics, 11 days earlier, had been ordered by FMCSA to cease all commercial transportation operations. The company had received an unsatisfactory safety rating following a comprehensive investigation.
Less than a week earlier, on Dec. 6, Diaby was stopped in Ohio for a roadside safety inspection while operating a 4 U Logistics tractor-trailer. Ohio State Highway Patrol Officers cited Diaby for records-of-duty status violations and for violating the FMCSA Dec. 1 order to cease all operations.
History of Violations4 U Logistics motor carrier authority was granted on June 30th. 2017 and it did not take long for this company to start raking in violations. In total the company raked in a total 40 safety violations, along with 10 out of service determinations with a 70% vehicle OOS and 18.8% driver OOS rating.. The company was involved in two motor vehicle accidents, one fatal.
On March 12th, 2019 one of the company’s drivers was involved in a motor vehicle accident while slowing for traffic when he was rear ended by a box truck who did not appear to slow down. The driver of the box truck was killed and the 4 U Logistics truck was transported with minor injuries. The company driver was not cited for the accident.
In addition, to everything above Diaby was previously convicted in the Spring of 2018 of having one or more open alcoholic beverage containers in his truck cab.
